1. Who we are
These Terms & Conditions ("Terms") govern your use of this website and your request for travel-related services from Ismail Sons("we", "us", "our"), with contact details listed on our contact page.
2. Nature of our services
We arrange and coordinate Hajj and Umrah travel services, which may include referrals to or bookings with third-party airlines, hotels, ground operators, insurers, and government or quasi-government processes such as visas and pilgrimage quotas. We are a travel coordinator, not a visa authority, airline, or hotel operator.
3. Consultation and quotations
Consultations (including those booked via our online calendar) are for guidance and planning. A consultation does not guarantee availability, pricing, or confirmation. Written quotations, if provided, are valid only for the period stated on them. Package descriptions on this website are summaries; binding inclusions appear only in a signed booking confirmation or formal invoice.
4. Bookings, deposits, and payment
When you confirm a booking, you agree to the payment schedule we communicate — typically including a deposit and instalments linked to supplier deadlines. Failure to pay on time may result in cancellation of reservations and forfeiture of amounts already paid to suppliers, subject to their rules and any non-refundable administrative fees we disclose in advance.
5. Passports, visas, and traveller responsibilities
You are responsible for a valid passport, accuracy of all personal data supplied, health fitness to travel, and compliance with Saudi Arabia's entry and pilgrimage regulations. Visa issuance is decided solely by competent authorities; refusal or delay is not grounds for compensation from us unless mandatory consumer law says otherwise.
6. Cancellations and changes by you
Cancellation and amendment fees depend on airline fare rules, hotel policies, visa status, and proximity to departure. We will apply supplier charges plus any documented administration fee stated in your booking agreement. Refunds, if any, may take several billing cycles to process through suppliers.
7. Changes and force majeure
Airlines may retime flights, hotels may substitute comparable properties, and government directives may alter programme structures — especially during Hajj. Where changes are material, we will explain options available under supplier rules. Neither party is liable for failure caused by events beyond reasonable control, including pandemics, natural disasters, strikes, war, or regulatory bans.
8. Third-party services and liability limits
Your contract for carriage, accommodation, and insurance is ultimately with third-party providers. Their terms apply in addition to ours. To the fullest extent permitted by applicable law in Sri Lanka, we are not liable for indirect or consequential losses. Our aggregate liability arising from any booking is limited to the total fees we earned for that specific booking unless the law requires otherwise.
9. Insurance and health
Adequate travel and medical insurance is strongly recommended. You must disclose medical conditions that may affect travel. We may refuse service where safety or supplier rules cannot be met.
10. Marketing, photographs, and privacy
Testimonials or photographs used on this site are illustrative unless attributed to a named pilgrim. Do not send sensitive documents over unsecured channels; we will specify secure submission methods during booking.
11. Governing law and disputes
These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law rules. Courts in Sri Lanka shall have non-exclusive jurisdiction, subject to any mandatory consumer protections where you reside.
